Insomnia “Til Death Dough Us Part” Promotion Terms & Conditions

Introduction

These terms and conditions (the “Terms”) govern your participation in our “Til Death Dough Us Part” promotion described below (“Promotion”). By taking part in the Promotion, you agree to be bound by these Terms. Participation in the Promotion is voluntary and does not require you to purchase anything from the Promoter.

The Promoter

Insomnia Cookies UK Ltd., a company registered in England and Wales with company number 14121624, Unit 4 Albany Park, Frimley Road, Camberley, Surrey, United Kingdom, GU16 7PQ (“Promoter”, “we”, “us”, “our”).

The Promotion

3.1. The Promotion will take place at the Promoter’s Fallowfield store (222 Wilmslow Rd, Fallowfield, Manchester M14 6LF) (“Promotion Location”) on 18 August 2024 (“Promotion Date”).

3.2. Participants who get a real Insomnia Cookies tattoo on the Promotion Date will be eligible to receive free cookies for life, subject to the conditions set forth in these Terms.

  1. The Promotion will operate as follows:
    1. A contracted tattoo artist will be available between 11:00 AM and 6:00 PM GMT on the Promotion Date at the Promotion Location. There will be a total of 14 separate 30-minute slots available between 11:00 AM and 6:00 PM GMT.
    2. Eligible participants will be asked to complete a release form. Individuals who provide affirmative answers to any of the health-related questions in the release form will not be eligible to receive a tattoo.
    3. The tattoo service will operate on a first-come, first-served basis for anyone in the queue who has completed a release form, until the maximum number of slots are filled.
    4. The tattoo will be performed by a third-party tattoo studio (Rain City Tattoos), which operates independently of the Promoter. The Promoter does not control, endorse, or assume responsibility for the actions, services, or omissions of the Tattoo Studio.

Eligibility

4.1. The Promotion is open to members of the public who are at least 18 years of age and who have provided negative answers to the health-related questions included in the Promoter’s release form provided at the time of participation.

4.2. Employees, independent contractors, officers, and directors of the Promoter, its affiliates and subsidiaries, and their immediate family members and persons living in the same household, are not eligible to participate in the Promotion.

4.3. The Promoter reserves the right at its sole discretion to disqualify from further participation in the Promotion any individual it has reason to believe is tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of these Terms, relevant laws, regulations, or third party rights.

The Gift

5.1. Participants who receive the tattoo will be entitled to one classic or deluxe cookie per day, which is not transferable, cannot be saved up or redeemed in advance. When you request your free cookie, you must show your tattoo at the point of sale in-store, along with your Insomnia Cookies Rewards individual barcode and valid photo ID. If the tattoo is removed or covered, this offer is no longer valid and the free cookie can no longer be redeemed. The offer is redeemable in-store only and is not redeemable online or via third-party delivery partners such as Deliveroo, UberEats, Just Eat, or Hungry Panda. The participant must register their details with the Promoter to prove identity, including but not limited to email address, full name, and photo ID. No cash equivalent will be available.

5.2. The gift is subject to product availability. There is no cash alternative for the gift and the Promoter reserves the right to substitute the gift with a gift of equal or greater value. Redemption of the offer is at the Store Manager’s discretion and service may be refused if these terms are not complied with.

Conditions

  1. The Promoter makes no warranties, representations, or guarantees, whether express or implied, regarding the quality, safety, or fitness for a particular purpose of the tattoo services provided by the Tattoo Studio. Participants acknowledge that any risks associated with getting a tattoo, including but not limited to health risks, are assumed by them and not by the Promoter. To the fullest extent permitted by law, the Promoter shall not be liable for any damages arising out of or in connection with the tattoo services provided by the Tattoo Studio, including but not limited to personal injury, infection, allergic reactions, scarring, or dissatisfaction with the tattoo design or placement. Participants agree to indemnify, defend, and hold harmless the Promoter, its agents, directors, officers, shareholders, employees, insurers, servants, parents, subsidiaries, divisions, affiliates, predecessors, successors, representatives, from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from or related to any actions or services provided by the Tattoo Studio, or any injuries or damages sustained by the participant as a result of the tattooing process. Any claims, disputes, or issues arising out of, or related to, the tattoo services provided should be directed solely to the Tattoo Studio. The Promoter will provide participants with the contact details of the Tattoo Studio upon request, but shall have no further involvement in any such matters.
  2. Nothing in these Terms affects your statutory rights as a consumer, or excludes or limits any liability of the Promoter that may not be excluded or limited at law.
  3. The Promoter reserves the right, in its sole discretion, to suspend, modify or cancel the Promotion at any time without notice.
  4. The Promoter reserves the right to cancel or amend these Terms at any time without notice.
  5. The Promoter reserves the right to seek damages from any individual who attempts to circumvent or breach the rules of the Promotion.

Data Protection

The Promoter will process participants’ personal data in accordance with the Privacy Notice provided to participants at the time of participation.

Governing Law and Disputes

The Promotion, these Terms and any disputes or claims (including non-contractual disputes or claims) arising under or related thereto or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales without regard to its conflict of laws provisions. Any dispute arising from them shall be subject to the exclusive jurisdiction of the English Courts.
